In the latest court battle, Evolution is taking on Light & Wonder (ex SG Digital) over the misappropriation of trade secrets.
A struggle at the start
Evolution is in the process of a lawsuit but has been hitting roadblocks from the start. Earlier in June, a Nevada court ordered Evolution to provide more information as they’ve requested to keep their complaint sealed. The complaint is in relation to the Lightning Roulette patent battlewith Light & Wonder.
Evolution is suing Light & Wonderin the Nevada District Court for alleged misappropriation of trade secrets linked to its Lightning Roulette game. In the complaint, Light & Wonder are accused of using the math filesand payout structuresfrom Lightning Roulette for its RouletteXand PowerXgames.
According to Evolution, these files were obtained during the negotiations where Evolution tried to partner with Light & Wonder to launch a land-based versionof the popular live casino game.
Evolution tried to file its complaint under seal, but many passages were redacted. However, Magistrate Judge Elayna J. Youchah stated that they must provide more information showing a compelling reason for wanting to do so.
According to Evolution, making the information available to the public would risk them being sued by L&W for violating the confidentialityprovisions between the two parties.
Judge Youchah insisted that they provide a factual basis for the nature of the information they wish to keep sealed to help support the legal reasoning for such a request. The court did not have enough information to grant the request and ordered Evolution to file a memorandum by 10 June.
Success in the redaction
Shortly after, Evolution succeeded in its bid to file redacted information in the infringement case against Light & Wonder. Judge Youchah agreed with their claim that there was a compelling reason to temporarily redactits complaint until there was a response from Light & Wonder.
Evolution made it clear that Light & Wonder has received both the redacted and original complaint, giving enough reasons to keep the documentation redacted until the defendants appear in court.
Response required
Now that Evolution has gained favour in filing documentation in a sealed form temporarily, we await the response from Light & Wonder. Judge Youchah only granted temporary redactions as public share could potentially harm their competitive positions and the integrity of the ongoing battle.
They also clarified that a more comprehensive review of the redactions will be expected once Light & Wonder enters the litigation process responding to the allegations. It’s a small victory, and Evolution has expressed its satisfaction with the court’s ruling, stating that the redactions are necessary if it wants to safeguard competitive information while upholding legal transparency long-term.
For now, we are waiting for Light & Wonder to respondto the allegations of misappropriating trade secrets regarding the Lightning Roulette game.
Their response will set the tone for the upcoming battle. So far, the only comment from the company was that they are aware of the lawsuit formed by Evolution and that they do not commenton ongoing litigations. The spokesperson also stated that they strongly believe these claims have no merit and that they will strongly defend against them.
